CBI Court Sentenced Two Travel Agents For 4 Years Imprisonment

Home:- Mr Jagjit Singh, The Special Judge, CBI court, has sentenced two travel immigration agents named Sham Lal and Mukesh Sharma to undergo 4 years of imprisonment in a cheating case registered against them almost 7 years ago by the CBI.

The court has also imposed a fine of Rs 41,000 on each accused.The CBI has alleged that the accused Sham Lal and Mukesh Sharma hatched a criminal conspiracy and created fake and forged employment documents for obtaining the emigration clearances for various emigrants.

The CBI conducted a surprise check at Protector of Emigrants (POE) Office at Kendriya Sadan, Sector 9, Chandigarh, in 2014. Files pertaining to applications submitted by Sham Lal and Mukesh Sharma to the POE, Chandigarh, for grant of emigration clearance of Saudi Arabia were taken into the possession.

Later on, It was found that the job category of more than 80 applicants was different from that of mentioned in the applications submitted by them.

The CBI had alleged that during investigation, They found that unskilled people were wrongly shown in skilled categories and emigration clearance was obtained without getting the documents of such unskilled persons attested from the Indian Mission/Embassy, which is a mandatory procedure, thereby cheating and causing loss to the government exchequer.

The CBI registered a case against Sham Lal and Mukesh Sharma for the offences punishable under Sections 420, 467,120-B, 468, 471 of the IPC and Under Section 24 of the Emigrants Act, 1983, and also arrested them on December 1, 2014. The trial court acquitted both accused Sham Lal and Mukesh Sharma in March 2021 saying the prosecution failed to prove the crime against them.

Later on Mr Narender Singh, a public prosecutor of the CBI, challenged the order and argued that the trial court had wrongly acquitted the respondents, whereas evidence on the file clearly proved the offence committed by both of them. There are ample evidences to show that the respondents obtained the emigration clearance from the POE, Chandigarh, on fake and forged documents.

Jagjit Singh, Special Judge, after hearing the argument set aside the order of the trial court and convicted both accused.
